1. Agreement to Terms

By accessing or using Vehicle Walk Around Check ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Vehicle Walk Around Check.

2. Description of Service

Vehicle Walk Around Check is a web-based application that enables commercial vehicle operators and drivers to conduct, record, and manage pre-departure walk-around inspections in accordance with UK and EU regulatory requirements. The Service includes inspection checklists, defect reporting, inspection history, fleet management tools, and subscription billing.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are of legal age and have the authority to enter into these Terms on behalf of yourself or any organisation you represent.

4. Account Registration

You must create an account to access the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. We reserve the right to terminate accounts that violate these Terms.

5. Free Trial and Subscription

New accounts are entitled to a 14-day free trial. After the trial period, continued access to the Service requires a paid subscription. Subscriptions are available on a monthly or annual basis and are billed in advance. Prices are displayed at the point of purchase and are inclusive of any applicable taxes.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods unless required by applicable law.

6. Payment

Payments are processed by Stripe, Inc. By providing payment information, you authorise us to charge the applicable subscription fees to your chosen payment method. You are responsible for ensuring your payment details are accurate and up to date. We are not responsible for any fees charged by your bank or payment provider.

7. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service to submit false, misleading, or fraudulent inspection records.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Use the Service in any way that could damage, disable, or impair its operation.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use the Service to transmit any harmful, offensive, or unlawful content.

8. Compliance Disclaimer

Vehicle Walk Around Check is designed to assist with pre-departure inspection record-keeping. It does not guarantee compliance with any specific regulatory requirement. You remain solely responsible for ensuring that your inspection processes meet all applicable legal obligations under UK and EU law, including but not limited to the Road Traffic Act 1988, the Road Vehicles (Construction and Use) Regulations 1986, and any applicable DVSA guidance.

9. Intellectual Property

All content, software, and materials forming part of the Service are owned by or licensed to Vehicle Walk Around Check and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for its intended purpose. No other rights are granted.

10. Limitation of Liability

To the maximum extent permitted by law, Vehicle Walk Around Check shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or regulatory penalties. Our total liability to you shall not exceed the amount paid by you for the Service in the three months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall do so.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date above. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
